
This album was recorded in 1995 with the lineup of The Prinicple of Evil Made Flesh, when the band was signed by Cacophonous Records. The album was never released, however, because in 1996, the band went through legal proceedings against their label, which the band accused of contractual and financial mismanagement. The recorded material was therefore unusable; Dani Filth stated the following about the incident in an interview to Kerrang in 2008:
“This was a bit of a weird one. We actually recorded it as our second release, but we then had to take our label to court which meant that most of it was temporarily lost for legal reasons. The next thing I know the band had split into two-halves, and after releasing the V Empire EP my half was able to re-record and finally release the album. In a way it actually worked in our favour, because after nearly two years of legal battles and non-stop hassle I think the troubles of the times actually came through on the recording. We actually worked with Kit Woolven on that one, who most people knew from working with Thin Lizzy, so it had a very lush edge as well as this distinctive, dark vibe. To this day this is the album that a lot of our fans seem to be really drawn to. And it catapulted us into a whole new world.”
The band split, having some members left Cradle of Filth to form The Blood Divine; with a new lineup, Cradle of Filth, who still had a contractual obligation with Cacophonous, recorded and released the EP V Empire or Dark Faerytales in Phallustein instead of Dusk and Her Embrace via Cacophonous. Signed in the meanwhile by Music for Nations, the English band re-recorded and released Dusk and Her Embrace with new songs and a new lineup on Music for Nations. The material of the original recording remained dormant for over twenty years, and some songs have never been released. Now the material of the original recording of 1995, a piece of history of black metal, will at last be released on July 8 on Cacophonous Records under the title Dusk... and Her Embrace - The Original Sin; it is not the usual commercial move, because this release actually contains a few unreleased songs, as one can see in the comparison of the two tracklists.
